下班你還是常常，接受老闆「線上指揮」嗎？新北市有一名，電子零件製造業廠務助理，下班後常常接到雇主，用通訊軟體指派任務，這名助理蒐集對話紀錄，成功申請加班費，也創下全國首例。
仲裁委員會認定助理，確實受雇主指揮監督，屬於加班時間，依通訊軟體對話的，頻率、次數、通話秒數計算，從103年1月到104年2月，這名助理平日加班358分鐘，假日加班1007分鐘，依勞工月薪2萬5200元，每分鐘薪資1.75元計算，資方應補發2598元加班費。
下班後用通訊軟體要給加班費，勞工怎麼舉證，通訊記錄內容怎麼認定，恐怕導致更多勞資糾紛。
